Welcome to SendAEO. These Terms of Service ("Terms") govern your access to and use of the SendAEO platform, website, software, services, and related offerings (collectively, the "Services") provided by SendAEO ("SendAEO," "we," "us," or "our").

By creating an account, accessing our platform, or using any SendAEO service, you agree to be bound by these Terms. If you do not agree with these Terms, you may not use the Services.

1. Description of Services

SendAEO provides businesses with integrated digital marketing tools designed to help manage their online presence, including but not limited to:

• Website development, hosting, and content management systems
• Inventory management and synchronization tools
• Search engine optimization (SEO) services
• Paid advertising management, including Google, Meta, and other advertising platforms
• Social media content creation, scheduling, and publishing
• Artificial intelligence-assisted content generation
• Analytics, reporting, and marketing performance tools
• Campaign management and promotional tools

The specific Services provided to you will depend on the subscription plan, service agreement, or order form selected by you.

2. Account Registration

To use certain features of SendAEO, you must create an account and provide accurate, complete, and current information.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify SendAEO immediately if you believe your account has been compromised or accessed without authorization.

You must be at least 18 years old and authorized to enter into agreements on behalf of your business or organization.

3. Subscription Plans and Payments

Certain SendAEO Services require payment of subscription fees, service fees, advertising management fees, or other charges.

• Fees are billed according to your selected plan or agreement.
• Subscription fees are generally billed in advance on a recurring basis.
• You authorize SendAEO to charge your selected payment method for applicable fees.
• Fees are non-refundable except where required by law or expressly agreed in writing.

SendAEO reserves the right to modify pricing with reasonable notice. Continued use of the Services after a pricing change becomes effective constitutes acceptance of the updated pricing.

4. Advertising and Third-Party Platforms

SendAEO may assist with advertising campaigns through third-party platforms, including Google, Meta, LinkedIn, and other advertising networks.

You acknowledge and agree that:

• Advertising results are not guaranteed.
• Campaign performance depends on factors outside SendAEO's control, including market conditions, competition, platform algorithms, budgets, and customer behavior.
• Advertising platforms may change policies, approval requirements, pricing, or availability without notice.
• Advertising spend paid directly to third-party platforms is separate from SendAEO service fees unless otherwise specified.

5. Website Hosting and Content

When SendAEO provides website hosting, development, or CMS services, we will use commercially reasonable efforts to maintain availability, security, and performance.

You are responsible for ensuring that all content, products, pricing, images, trademarks, descriptions, and information provided to SendAEO are accurate and legally permitted for use.

SendAEO is not responsible for errors caused by inaccurate, incomplete, outdated, or unauthorized information supplied by you.

6. Inventory and Data Synchronization

SendAEO may provide tools that synchronize inventory, products, pricing, availability, and related information across websites, social media platforms, advertising channels, and other connected services.

You acknowledge that:

• Synchronization depends on third-party systems and APIs.
• Occasional delays, errors, or interruptions may occur.
• You are responsible for verifying product information before publication or sale.
• SendAEO is not responsible for losses caused by inaccurate inventory, pricing, availability, or third-party system failures.

7. Artificial Intelligence Features

SendAEO may provide artificial intelligence-assisted features, including content generation, recommendations, automation, and marketing suggestions.

AI-generated content should be reviewed before publication. While SendAEO uses reasonable efforts to provide useful and accurate content, AI-generated output may contain errors, omissions, or inaccuracies.

You are responsible for approving, modifying, and ensuring compliance of any content published using SendAEO tools.

8. Customer Responsibilities

You agree that you will:

• Provide accurate business, product, and account information.
• Maintain appropriate licenses, permissions, and rights for submitted content.
• Comply with all applicable laws, regulations, and advertising requirements.
• Not use SendAEO for unlawful, fraudulent, misleading, or abusive activities.
• Not attempt to interfere with the security, operation, or availability of the Services.

9. Intellectual Property

SendAEO owns all rights, title, and interest in the SendAEO platform, software, technology, designs, trademarks, documentation, and proprietary systems.

You retain ownership of your business content, including your products, images, trademarks, and materials provided to SendAEO.

By using the Services, you grant SendAEO a limited license to use, process, store, and display your content solely as necessary to provide and improve the Services.

10. Third-Party Services

SendAEO integrates with third-party services and platforms. These services are controlled by third parties and may have separate terms, policies, limitations, or availability requirements.

SendAEO is not responsible for interruptions, policy changes, account suspensions, or losses caused by third-party providers.

11. Service Availability

We strive to provide reliable service but do not guarantee uninterrupted availability.

Services may occasionally be unavailable due to maintenance, updates, security issues, hosting problems, third-party failures, or circumstances outside our reasonable control.

12. Termination

Either party may terminate Services according to the applicable subscription plan or service agreement.

SendAEO may suspend or terminate access if you:

• Violate these Terms;
• Fail to pay required fees;
• Use the Services in a manner that creates legal, security, or operational risk.

Upon termination, your access to certain Services may end immediately. Any outstanding balances remain due.

13. Limitation of Liability

To the maximum extent permitted by law, SendAEO shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost revenue, lost data, or business interruption.

SendAEO's total liability arising from or related to the Services shall not exceed the amount paid by you to SendAEO during the three (3) months immediately preceding the event giving rise to the claim.

14. Disclaimer of Guarantees

SendAEO does not guarantee specific business results, including but not limited to:

• Search engine rankings;
• Advertising performance;
• Sales increases;
• Website traffic;
• Customer acquisition;
• Revenue growth.

Marketing performance varies based on numerous factors outside of SendAEO's control.

15. Indemnification

You agree to defend, indemnify, and hold harmless SendAEO and its affiliates, employees, and partners from claims, damages, liabilities, and expenses arising from:

• Your use of the Services;
• Your content or materials;
• Your violation of these Terms;
• Your violation of applicable laws or third-party rights.

16. Privacy

Your use of SendAEO is also governed by our Privacy Policy, which explains how we collect, use, and protect information.

17. Changes to These Terms

SendAEO may update these Terms periodically. Updated Terms will be posted on this page with a revised effective date.

Your continued use of the Services after changes become effective means you accept the updated Terms.

18. Governing Law

These Terms shall be governed by and interpreted according to the laws of the State of Colorado, without regard to conflict of law principles.

Any disputes arising from these Terms or the Services shall be resolved in the applicable state or federal courts located in Colorado, unless otherwise agreed in writing.

19. Cookies and Similar Technologies

SendAEO uses cookies and similar technologies to operate our website and Services, remember user preferences, maintain secure sessions, analyze website traffic, improve platform performance, and support marketing and advertising activities.

By using the Services, you consent to our use of cookies and similar technologies as described in our Privacy Policy. You may manage or disable cookies through your browser settings; however, doing so may affect the functionality, performance, or availability of certain features of the Services.

Certain third-party services integrated with SendAEO, including analytics providers, payment processors, advertising platforms, and social media platforms, may also place cookies or similar technologies in accordance with their own privacy policies. SendAEO does not control the cookies or data collection practices of these third parties.
